Terms of Engagement

These terms describe how Dynamic Concepts Plus (“DCP,” “we,” “us”), 300 Business Park Circle, Suite 1A, Stoughton, WI 53589, works with clients (“you”). By approving a written scope and estimate, or by paying an invoice for our work, you agree to these terms. Questions? Call 608.205.9600 or email dan@dynamicconceptsplus.com.

1. Scope and Estimate

Every project gets a written scope and estimate before work begins. The scope describes what we will do and what is not included. Package prices on our Pricing page are starting points; the written estimate for your project is what applies to you. Estimates are valid for 30 days.

Work outside the agreed scope, and changes you request after the scope is approved, are billed as change orders at our published hourly rates. We will describe the additional cost and get your written approval (email is fine) before that work starts. Consultations and estimates are free.

2. Pricing and Rates

  • Our published prices and rates are on the Pricing page: website packages, online store packages, hosting and care plans, product development and prototyping rates, sourcing rates, and hourly rates.
  • Hourly work is billed at the rates on the Pricing page. Content edits outside a care plan have a half-hour minimum, as stated there.
  • CNC-machined prototypes, SEO, and online advertising are quoted per project.
  • The estimate you approve stays in effect for that project, even if our published prices change later.

3. Payment

  • Invoices are paid online by card through Stripe’s secure checkout page, linked from our Pay page. We never see or store your full card number. A receipt is emailed to you after payment goes through.
  • Deposit: projects over $1,000 require a 50% deposit before work starts. Hourly work and care plans do not require a deposit.
  • Staged billing: projects over $4,500 are billed in stages: 50% at the start, 25% at design approval, and 25% before launch.
  • Due dates: invoices are due 14 days after the invoice date. The final invoice on a website project is due within 7 days.
  • Late payment: we do not charge late fees at this time. If an invoice is more than 30 days unpaid, we pause work until it is paid.
  • Taxes: we charge sales tax only where Wisconsin law requires it.

4. Website and Store Projects

  • Website packages include the number of pages and revision rounds listed for that package on the Pricing page. Revisions beyond the included rounds are billed at the hourly rates.
  • Revisions: each design phase includes two rounds of revisions. A round is one consolidated set of changes from you. Please send feedback within 10 business days; if we have not heard from you by then, the project is paused until we do.
  • Some packages include a period of post-launch fixes, as listed on the Pricing page. That period covers fixes to the work we delivered, not new features or content changes.
  • Timelines depend on you providing content, images, and feedback in a timely way.

5. Hosting and Care Plans

  • Hosting and care plans are billed monthly at the prices on the Pricing page, which also lists what each plan includes.
  • Plans are month to month. You can cancel at any time with 30 days’ notice. We do not refund partial months.
  • Edit time included in your plan is per month and expires at the end of each month.
  • Edits beyond the time included in your plan are billed at the hourly rate listed on the Pricing page.
  • If a plan ends, we can hand your site off to you or your new host on request. We keep backups for 30 days after the plan ends.

6. Product Development and Prototyping

  • CAD design and consulting are billed at the rates on the Pricing page, including the prepaid consulting blocks. 3D printing is priced as listed there. CNC-machined prototypes are quoted per project.
  • Prototypes are for testing and development. Testing and refining a design can take several rounds, and we will review results with you as the work goes.
  • CAD deliverables: STEP files and PDF drawings are included. Native SolidWorks files are available for an additional charge, quoted on request.

7. Manufacturing Sourcing

  • We help you find and evaluate production suppliers, working with production partners worldwide, and we help with quality checks. Sourcing consulting is billed hourly or at a fixed project price, as listed on the Pricing page.
  • The optional buying-agent service is charged as a commission on the product order value, with the rates and per-order minimum listed on the Pricing page.
  • You sign the supplier contracts, and you are responsible for inspecting and accepting deliveries. We do not manufacture products in volume ourselves and do not guarantee supplier performance.

8. SEO and Online Advertising

SEO and advertising are quoted per project. Results depend on your market, competition, and budget, so we do not promise specific rankings or ad results. You own your advertising accounts and pay the advertising platforms directly. Ad spend is separate from our fees.

9. Your Responsibilities

You agree to give us accurate information, content, and materials you have the right to use, and to review our work and respond in a timely way. You are responsible for the content you supply and for having the legal right to use it.

10. Ownership and Materials

You keep ownership of the materials you provide to us. Once you have paid in full, you own the final designs, CAD files, and website we create for you. Third-party items such as themes, plugins, fonts, and stock images stay under their own licenses. We may show non-confidential work in our portfolio unless you tell us you would like to opt out.

11. Confidentiality

We treat non-public information you share about your product or business as confidential and use it only to do the work. If you need a signed non-disclosure agreement, tell us and we will review it before work begins.

12. Warranty and Limits of Liability

We will do the work with reasonable care. Except as stated in these terms, we provide our services “as is,” without other warranties. To the extent the law allows, our total liability for a project is limited to the fees you paid us for that project, and we are not liable for indirect or consequential damages such as lost profits.

13. Ending an Engagement

Either of us may end a project with 14 days’ written notice. You pay for work completed through the end of the notice period. See our Refund and Cancellation Policy for how refunds work.

14. Governing Law and Disputes

These terms are governed by the laws of the State of Wisconsin. Disputes will be handled in the courts located in Dane County, Wisconsin. We encourage you to contact us first so we can try to work things out.

15. Changes to These Terms

We may update these terms. The version in effect when you approve your scope and estimate applies to that project.
